I wrote this for Fulcrum in May. The Court’s refusal to allow Alabama to use its revised, gerrymandered map is an indication that, at least in voting rights, public pressure may be having an impact.
Indeed. In same way that Brown could not have happened 10 years earlier, Kavanaugh--who Dahlia Lithwick said was "in the bag" to change his vote, would have done so 10 years earlier. Only an aroused majority cannot unseat an entrenched minority.
Thanks for this well written, informative, and refreshingly hopeful post. As you point out, SC Justices are human and have many of the same human quirks we all have. A few might always relish "the public be damned" approach, but most will heed to some extent the reality of public opinion and what's going on in the real world. We do have some agency after all!
